Kuhn's Appeal Adjudicated
Thomas Kuhn, a priest, was convicted of 11 criminal acts against
minors in 2004 including an offense for masturbation in front of a
minor. He appealed several aspects of the decisions made by the
Common Pleas Court that convicted him. The Appeals Court rendered
its decision on those appeals on December 23, 2005.

In summary, the Appelate Court upheld the decisions made by the
Common Pleas Court... with one exception. They overturned the
community control sanction that required Kuhn to stay at least 1,000
ft away from schools and daycare centers. The overturned that
sanction because the effect was achieved by the earlier sanction that
Kuhn not offer his services to any agency that services those under
21 years of age, a condition which Kuhn violated and subsequently was
ordered to jail for 30 days.
Kuhn now must complete the remaining 3 1/2 years of probation and
abide by the Community Controls imposed by the Common Pleas Court.
He last recourse would be to appeal to the Ohio Supreme Court (not
likely to even agree to hear the case).
It is now time for Archbishop Pilarczyk o be a man of his word. He
promised Kris Ward and I that he would deal with Kuhn as soon as the
civil authorities were finished. That time has come.... the time to
take Kuhn's Roman Collar.
